Electronic signature for more secure electronic communications
Podgorica, (Montena-business)-The purpose of the Law on electronic signature is to improve safe and efficient use of electronic communication by regulating conditions for digital signatures and the organization which will give certificates for it, claim the authors of the law outline. The outline was presented yesterday for the first time to Montenegrin public, which can give complaints and suggestions on the outline in the next seven days. "The Digital signature consists of electronic data from the machine for signature creation, which is used for checking signature and data validity" it is written in the outline. The organization that gives certificates, would define under which conditions the certificate would be valid, such as name of a signature, information about him, time of certificate#s validity, area of it#s use and identification code. It is predicted that the office which gives certificates assure it#s secure usage and control the system. "The organization that gives certificates will pay a fee for losses caused by accident or consciously, and will not be responsible for using a certificate beyond the appointed area of use or for breaking agreed amount that certificate refers to" it is written in the outline. The authors of the outline claim that for signature creation should secure the data used for making digital signature, to appear only once and stay secret, and be protected from falsification and illegal use. "Detailed roles on checking and paying fees will be approved by the Secretariat for Development of Montenegro" says the outline. According to the outline, the Agency for Telecommunications would be appointed to control approving of certificates and the organization that approves it as well. "Valid certificates approved by the organization from a country outside the EU will be recognized by the EU if the domestic institution fulfils conditions of the Law on electronic signature or if the institution#s work is guaranteed by a foreign organization for approving certificates" it is written in the outline. The persons that break the Law on electronic signature or orders of the Agency for Telecommunications will face punishment measures. According to Dragan Prlja from the Institute for comparable law, the Law on electronic trade doesn#t refer to trade on Internet only, but all electronic payments and contract agreements, exchange of any kind of commercial information between companies and financial institutions that will make business at the Montenegrin market. af/bd
