CITUM: Set of Commercial and Working Laws as Contribution to the Market Economy
Podgorica, (Montena-business) - The members of CITUM#s working group concluded at today#s press conference that a set of Commercial and Working Laws were a contribution to the market economy and to a modern judicial system. It is about the Laws on Work, on Employment, on Companies and their Insolvency, which will be adopted during this month at the Parliament. After that, a new Collective Agreement will be signed. The Secretary of CITUM, Mr Budimir Sljivancanin said that the new Law on Work will define use of the Collective Agreement at all the levels, from the State to the companies, and it will equalise labour price to a guaranteed price. "The employer can pay a guarantee salary for 3 months the most, and he must provide unpaid salaries to the employees according to a special collective agreement at the end of the periodical counting" said Mr Sljivancanin. He added that this law included institutes of ransom of working age and of 24 salaries, and it would assure to CITUM a high degree of making decisions at work matters. CITUM sent to the organ which proposes laws, amendments in which it is demanded that the contracts on work have to be signed for an undecided period, and that a temporary loss of working ability, a bankruptcy or liquidation of a company shouldn#t be the reason for losing the job. Ms Rosa Popovic, a member of the working group, said that the Law on Work would protect maternity and employed women according to international standards. "Instead of maternity in the proposal of the Law, it was put parenthood, so that maternal release could be used by a parent with lower salary. During pregnancy and delivering, a woman can not be sent to a more difficult working place nor can she be dismissed" said Ms Popovic. She added that women had the right of one-hour pause for breast feeding their baby, if they start to work 45 days after delivery, and that they would have paid transport costs if their working place was more than 5 kilometres away from their job. "The Law on Company#s Insolvency, will improve the procedure of bankruptcy by reducing the role of court at that process and by reducing the bankruptcy#s terms" claims Mr Dragan Mijanovic. "All payments will be done outside court, and the debtors will not be protected as it was before. This Law is important for foreign investments and it will help revival of the companies" said Mr Mijanovic. This set of Commercial and Working Laws is a precondition for adoption of a new General Collective Agreement, which will regulate the work of about 43,000 employees in Montenegro, said Mr Miodrag Pajovic. He reminded that the Government accepted the proposal of these laws, which were adopted by CITUM already in June 2000. af/bd
