Constitutional Court to review constitutionality of two laws defining persons considered connected to public officials

 

Podgorica, (MINA) - The Constitutional Court has initiated proceedings to assess the constitutionality of provisions of the Law on the Prevention of Money Laundering and Terrorist Financing, as well as the Law on Prevention of Corruption, which define which persons are considered connected to a public official and are therefore subject to the obligation of maintaining personal data records.

According to a press release from the Constitutional Court, the procedure was initiated following an initiative submitted by a Supreme Court’s judges.

“The Constitutional Court has launched proceedings to assess the constitutionality of provisions in two laws that define who is considered a person connected to a public official and therefore subject to the obligation of having their personal data recorded without their consent,” the Court’s press release reads.

The Court noted that the Law on the Prevention of Money Laundering and Terrorist Financing stipulates that politically exposed persons include members of a public official’s immediate family, among others, relatives in the direct line of descent to any degree of kinship.

“The other law stipulates that, when submitting an asset declaration, an official must provide personal data for related persons, including relatives up to the second degree of kinship, in-laws up to the first degree, as well as persons with whom the official has established a business, political, or personal relationship,” the press release continues.
