Milatovic withdraws request for review of constitutionality of Constitutional Court Law

 

Podgorica, (MINA) - The Constitutional Court of Montenegro has suspended the procedure reviewing the constitutionality of the provisions of the Law on the Constitutional Court, after the President, Jakov Milatovic, informed the Court that he was withdrawing his submission.

Milatovic had requested back in June a review of the constitutionality of a provision of the Law on the Constitutional Court that regulates who is authorized to initiate proceedings, arguing that it was contrary to the Constitution.

The Law on the Constitutional Court stipulates that a proposal for reviewing constitutionality and legality may be submitted, among others, by a state authority, if the law in question is one that the authority applies in its work.

Milatovic argued that such a provision violates the Constitution, which does not provide for any limitations regarding which state authorities are authorized to initiate proceedings before the Court.

“Milatovic informed the Court that the Ministry of Justice has announced amendments to the Law on the Constitutional Court, and therefore he considers it justified to initiate amendments to this legal provision within the procedure”, the Court said.
